Welcome to Renee Hart Photography. By using our website www.reneehart.co.nz and booking our photography services, you agree to these Terms and Conditions. Please read them carefully.

2. Services

Our family photography services include, but are not limited to, portrait sessions, digital images, and printed products as outlined on website renee.hart.co.nz. Service details and pricing are subject to change without notice.

3. Booking and Payment

• 3.1 Booking: To book a session, you must complete our online booking form and pay a deposit as specified on our website. The deposit secures your session date and time agreed upon, the photographer will not make any other bookings for that allocation of session. For this reason, the deposit fee is non-refundable and date is non-transferrable unless prior discussed with photographer.

• 3.2 Payment: Full payment is due 3 days prior of the session day unless otherwise agreed upon with photographer.

4. Cancellations and Rescheduling

• 4.1 Cancellations: If you need to cancel your session, please notify us at least 14 days before the scheduled date to receive a full refund of your deposit. Cancellations made less than 7 days before the session may result in forfeiture of the deposit. In the event of cancellation by photographer or unlikely event of photographic failure, liability limited to a full refund of any fees paid back to client.

• 4.2 Rescheduling: You may reschedule your session. Rescheduling is subject to availability. If weather is unsuitable this will be decided by photographer, no deposit fees refunded due to weather conditions as out of photographers control. If due to sickness then sessions can be rescheduled to a new arranged date.

5. Client Responsibilities

• 5.1 Cooperation: The client(s) agree to cooperate with photographer to ensure a successful session. This includes arriving on time, following instructions given by photographer, and providing any necessary information or permissions. In order to have a successful session the client(s) must be willing to participate to the best of their ability with good attitude in order to produce desired results.

• 5.2 Children and Pets: The client(s) are responsible for the behavior and safety of any children or pets present during the session.

• 5.3 Storage: The client is required to safely store and back up images, on own computer and/or USB, external hard drives. The photographer will retain clients images for only 3 months.

6. Use of Images

• 6.1 Copyright: All images taken during the session are the property of Renee Hart Photography. The client is granted a non-exclusive, non-transferable license to use the images for personal purposes only.

• 6.2 Release: By participating in the session, you grant the photographer permission to use the images for promotional purposes, including on their website, social media, and marketing materials, unless otherwise agreed in writing by the client.

  7. Delivery and Products

• 7.1 Delivery: Digital images and/or prints will be delivered as specified in your package. Delivery times may vary based on the package and post production editing time.

• 7.2 Product Quality: The photographer strives to deliver high-quality products. Any issues with the products must be reported within 3 days of receiving your online gallery for resolution.

  8. Limitation of Liability

• 8.1 Liability: The Photographer’s liability is limited to the amount paid for the session. The Photographer is not liable for any indirect, incidental, or consequential damages arising from the use of the services or products.

• 8.2 Force Majeure: The Photographer is not liable for any failure or delay in providing services due to circumstances beyond their control, including natural disasters, emergencies, or equipment failure.

  9. Privacy and Data Protection

• 9.1 Privacy: We are committed to protecting your privacy. Personal information collected will be used solely for the purposes of providing our services and will not be shared with third parties without your consent.

• 9.2 Data Security: While the Photographer implements reasonable security measures, they cannot guarantee the absolute security of any information transmitted over the internet.

  10. Modifications

  I Renee Hart Photography Ltd. reserve the right to modify these Terms and Conditions at any time. Changes will be posted on website or emailed to client and will be effective immediately upon posting.

  11. Governing Law

  These Terms and Conditions are governed by and construed in accordance with the laws of Dispute Tribunal New Zealand. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Dispute Tribunal New Zealand.

  12. Confidentiality of Session Guide/Package Information

  Please note that the information provided in this pamphlet, including package details, pricing, sessions guide, and session specifics, is intended solely for your personal use and planning. I kindly request that you do not share, copy, or distribute this information to others. Each family’s session is unique, and our packages and pricing are tailored to ensure the best experience for our clients.
